The Senate Health Committee has approved legislation targeting pseudo-medical practitioners, aiming to eliminate dangerous health misinformation and harmful, scientifically unsupported treatments, such as the promotion of vitamin C as a cancer cure. <\/p>\n
Public misinformation spread by figures like Jerzy Zi\u0119ba and others may soon disappear from public discourse. The Senate Health Committee has issued a positive opinion on the “Charlatan Act,” which aims to eliminate services that endanger patient life and health while remaining inconsistent with modern medical knowledge.<\/p>\n
During a Tuesday session, senators supported editorial amendments proposed by the Senate Legislative Office regarding the act on patient rights and the Patient Rights Ombudsman.<\/p>\n
Developed by the Ministry of Health in cooperation with the Patient Rights Ombudsman (RPP), the regulation empowers the Ombudsman to issue public warnings if a party engages in practices threatening to patients. The office will also gain the authority to issue temporary orders requiring entities to immediately cease specific actions before formal proceedings conclude.<\/p>\n
Furthermore, the Ombudsman will be authorized to initiate and participate in civil proceedings concerning patient rights, exercising the same powers currently granted to the prosecutor.<\/p>\n
The legislation seeks to distinguish between safe, long-standing, evidence-based phytotherapy used as a supplement to traditional treatment and dangerous quackery. Upon the act’s implementation, no entity will be permitted to provide health services without an official entry in the Registry of Entities Performing Medical Activities.<\/p>\n
The Ministry of Health and the RPP have established significant financial penalties for non-compliance. Violating the collective rights of patients could result in a fine of up to 1 million PLN, while failure to cooperate with the Ombudsman carries a penalty of up to 100,000 PLN. These sanctions remain applicable even if the activity is ceased shortly before a formal decision is issued.<\/p>\n
The proposed regulations sparked significant debate during the consultation phase, particularly among associations representing herbalists, acupuncturists, homeopaths, and cosmetic salons. Nearly 5,000 comments were submitted by institutions including the Supreme Medical Council, the Supreme Council of Nurses and Midwives, the Polish Insurance Association, and various patient foundations and trade chambers.<\/p>\n
