The Polish government has introduced a legislative bill to create a public register of property managers, reinstate professional liability, and impose strict financial penalties for legal violations. <\/p>\n

For now, these are proposals included in a draft bill.<\/p>\n
The Ministry of Development and Technology has prepared a draft amendment to the real estate management act (UD438). The project attempts to reverse changes introduced over a decade ago. In 2014, state licenses for property managers and the professional liability system were abolished. According to the authors, current regulations do not allow for the effective verification of professional competence, prompting the creation of a central register and the restoration of professional oversight.<\/p>\n
The authors point out that currently, the only formal requirements for a property manager are running a business, signing a contract with the property owner, and holding mandatory third-party liability insurance. There is no unified system for verifying competence or a state register of professionals.<\/p>\n
The justification also emphasizes that the ministry receives complaints regarding the quality of services provided by some managers. Frequently reported problems include hindering access to financial documentation, creating unreliable economic plans, failing to answer apartment owners’ questions, and rejecting initiatives submitted by residents.<\/p>\n
According to the drafters, the current system means that people dissatisfied with a manager’s actions can often only pursue their rights in court, which involves costs and long waiting times for a resolution.<\/p>\n
One of the most important changes is the creation of the Central Register of Property Managers, maintained by the minister responsible for construction. The draft assumes that practicing the profession will only be possible after obtaining an entry in this register. To receive it, the candidate must submit an application, pay a fee, and meet specific conditions, including full legal capacity and a clean criminal record for specific offenses.<\/p>\n
The register will be publicly available on the ministry’s website. The draft provides that the Central Register of Property Managers will contain information on third-party liability insurance and entities for which the manager provides services. Managers will also be required to keep this information updated.<\/p>\n
Furthermore, the system of professional liability is to be restored. Proceedings will be conducted by the minister responsible for construction, and cases will be handled by a specially appointed Commission for the Professional Liability of Property Managers.<\/p>\n
As a rule, proceedings will be initiated at the request of a party to the property management contract after paying a fee. In exceptional cases, the minister may initiate them ex officio. The complainant will be a party to the proceeding, which\u2014according to the project\u2014is also intended to facilitate the amicable resolution of disputes.<\/p>\n
If a manager violates regulations, the project provides for the possibility of applying one or more sanctions. Additionally, the draft assumes the possibility of imposing an administrative fine of up to 50,000 PLN, among other things, for providing false information in the register or failing to update it. Sanctions will also threaten those performing management activities without the required register entry.<\/p>\n
For now, these are exclusively assumptions. The project has been entered into the legislative and program work schedule of the Council of Ministers, and its adoption by the government is planned for the fourth quarter of 2026.
