President Karol Nawrocki will administer the oath of office to Constitutional Tribunal Judge S\u0142awomir Patyra next Tuesday, July 28, following months of delays and institutional standoff. <\/p>\n
S\u0142awomir Patyra was chosen by the Sejm as a Constitutional Tribunal judge to replace judge Andrzej Zielonacki, whose term ended on June 28. The judge has not yet assumed his official duties because the president had not previously received his oath. On July 3, he informed that he sent a letter to President Karol Nawrocki asking for the date of his oath to be set. He indicated that he wanted to signal in this way his readiness to establish an employment relationship in the Tribunal.<\/p>\n
“Next Tuesday, July 28, President Karol Nawrocki, acting pursuant to Article 4 sec. 1 of the Act on the Status of Judges of the Constitutional Tribunal, will accept the oath from Prof. S\u0142awomir Patyra and on the same day will hand over appointments to four new judges of the Supreme Court,” Bogucki wrote on the X platform. The head of KPRP added that next week the president also plans to appoint 211 district court assessors and 18 provincial administrative court assessors.<\/p>\n
On Tuesday, July 21, we described on Gazeta.pl that Judge Patyra addressed President Nawrocki for the second time to set the date of the oath in the Constitutional Tribunal. “I am turning again to Mr. President to indicate the date on which – in the presence of Mr. President – I will be able to take the oath,” Patyra wrote, invoking the provisions of the act on the status of judges of the Constitutional Tribunal. As he emphasized, completing this formality is a condition necessary to establish an employment relationship – without it, he cannot formally assume the function. At the same time, he cares that the oath takes place precisely before the head of state.<\/p>\n
The judge also referred to his academic achievements. As a constitutionalist with over 31 years of teaching experience, he noted that for years he taught students respect for state institutions and applicable legal procedures, and that is precisely why he cares about carrying out the oath in accordance with the law and constitutional order.<\/p>\n
He also recalled the cooperation of the president and the Tribunal in the process of guaranteeing the supremacy of the constitution, pointing out that the head of state has the prerogative to direct applications in the mode of preventive control, which the Tribunal then examines. This mutual connection of both institutions is supposed to be – according to the judge – an additional argument for quickly setting the date.<\/p>\n
Last Wednesday, July 15, Sejm Marshal W\u0142odzimierz Czarzasty informed that on Monday he sent a letter to Karol Nawrocki in which he appeals for immediate action enabling S\u0142awomir Patyra to take up the mandate of a Tribunal judge. Prime Minister Donald Tusk said in turn on Friday that the Tribunal “must be supplemented by judges chosen by the Sejm, whether someone likes it or not.” – We will enforce this by all available means – the head of government emphasized.<\/p>\n
Dr. hab. S\u0142awomir Patyra was born on March 27, 1970, in Pyrzyce. He studied at the Faculty of Law and Administration of Maria Curie-Sk\u0142odowska University in Lublin. In the years 1995-1997, he completed prosecutor training in that city. He currently works at the Maria Curie-Sk\u0142odowska University in Lublin. He is, among other things, a co-author of several textbooks in the field of constitutional law, the constitutional system of state organs, and bodies of control and protection of law. During his academic career, he also lectured at the University of Radom. Since 2013, he has also been a legal advisor.<\/p>\n
The Sejm elects Tribunal judges individually, for nine-year terms, by an absolute majority of votes. In this term of the Sejm, the current majority did not fill emerging vacancies in the Tribunal until March of this year. In March, the Sejm elected six Tribunal judges, supplementing the Tribunal’s composition to the statutory number of 15 judges. These were the judges: Magdalena Bentkowska, Dariusz Szostek, Maciej Taborowski, Marcin Dziurda, Krystian Markiewicz, and Anna Korwin-Piotrowska.<\/p>\n
On April 1, Szostek and Bentkowska took the oath at the invitation of Nawrocki at the Presidential Palace. Representatives of KPRP indicated at the time that the situation of the four remaining judges is being analyzed, because – according to the presidential chancellery – errors occurred in the Sejm. The situation of these judges still remains the subject of dispute.<\/p>\n
On April 9, during a ceremony in the Sejm’s Column Hall, they took the oath with the formula that they are doing so “before the president.” Judges Bentkowska and Szostek also took the oath again at that time. Then, all of them submitted written oath texts to the office of the Chancellery of the President of the Republic of Poland.<\/p>\n
Judges Szostek and Bentkowska assumed offices in the Tribunal on the same day. Tribunal President Bogdan \u015awi\u0119czkowski said that the four remaining people did not assume offices because the events in the Sejm with their participation cannot be recognized as an oath “before the president.” A day later, Markiewicz informed that he and the three remaining judges submitted a letter to the Tribunal president with a request to enable them to perform official duties.<\/p>\n","protected":false},"excerpt":{"rendered":"
