Poles have rushed en masse to submission windows, with the number of filed documents increasing by up to a thousand percent in some regions of the country. There is one sole reason: the inexorably approaching August 31 deadline, which sets the limit on the rules for disposing of one’s own land. Everything indicates that whoever fails to secure their interests in time may lose the possibility of building their dream home for many years.<\/p>\n
A genuine assault on municipal spatial planning and construction departments is well underway. Thousands of applications for zoning decisions, popularly known as “wuzetka” decisions, are flowing into official windows. The scale of the phenomenon has reached dimensions that local governments have not dealt with until now.<\/p>\n
Increases range from several hundred to even a thousand percent, admitted Dr. \u0141ukasz Grzesiak, an urban planner and head of the Spatial Planning and Construction Department at the K\u0142odawa Commune Office, in a statement to “Dziennik Gazeta Prawna.” Such a flood of documentation means massive legislative backlogs and forces officials to work under colossal time pressure.<\/p>\n
Given the dramatic situation in municipal offices, Confederation MPs decided to intervene by submitting a parliamentary interpellation to the Ministry of Development and Technology. The parliamentarians pointed out that due to severely limited staffing resources in local governments, many zoning decision proceedings will not even be initiated before the new regulations take effect\u2014even though investors submitted documents well in advance.<\/p>\n
However, hopes for support from the government administration were quickly dispelled. As Deputy Minister of Development and Technology Tomasz Lewandowski announced in response to the interpellation, the ministry does not plan to introduce any additional financial or staffing mechanisms. Local governments must therefore cope with this problem entirely on their own.<\/p>\n
As the WNP service points out, intensive work is still underway in many communes to implement general plans that will determine property values and development opportunities for many years to come.<\/p>\n
The cause of the mass mobilization of plot owners is the ending transitional period in spatial planning reform. Previous studies of spatial development conditions and directions will remain valid only until August 31, 2026. This is the final date by which communes must adopt so-called general plans.<\/p>\n
New general plans will precisely divide municipal areas into zones and determine where residential development will be permissible and where it will be categorically banned. Plots not covered by a local zoning plan will gain the right to be built on only if they are located in the so-called built-up area supplementation zone (OUZ).
