The Ministry of Justice has announced disciplinary proceedings against three judges in connection with the high-profile “hate affair” case, introducing formal charges regarding data misuse and defamation. <\/p>\n
The Ministry of Justice announced that Tomasz \u0141adny, the deputy disciplinary rzecznik (spokesperson) for judges, has initiated disciplinary proceedings against Jakub Iwaniec, Rafa\u0142 Puchalski, and Przemys\u0142aw Radzik, formally presenting them with disciplinary charges.<\/p>\n
This case is linked to events media outlets refer to as the “hate affair.” According to the ministry’s announcement, judges Iwaniec and Puchalski are accused of participating from February 2018 to April 2000 in organizing and conducting actions directed against other judges.<\/p>\n
Deputy disciplinary rzecznik Tomasz \u0141adny accuses judge Przemys\u0142aw Radzik of breaching the dignity of a judicial office by unauthorized disclosure of information obtained during official duties and publishing defamatory content about common court judges.<\/p>\n
According to the ministry’s Wednesday announcement, judge Iwaniec is specifically accused of receiving unauthorized personal document files of another judge (“green folders”) on February 19\u201320, 2018, while delegated to the Ministry of Justice, and forwarding detailed personal data from his private email to unauthorized persons.<\/p>\n
Judge Puchalski is accused by the deputy disciplinary rzecznik of unlawfully acquiring judges’ “green folders” from ministry collections without authorization in January 2018, and later sharing personal career details with unauthorized persons.<\/p>\n
Furthermore, in March 2018, while serving as President of the Regional Court in Rzesz\u00f3w, Puchalski allegedly exceeded his powers by reviewing another judge’s personal files without legal basis, photocopying lustration and disciplinary proceedings documents, and emailing them to unauthorized individuals.<\/p>\n
In June 2024, the regional prosecutor in Wroc\u0142aw filed motions for permission to hold judge Iwaniec criminally responsible regarding the “hate affair.” Requests to lift immunity also targeted \u0141ukasz Piebiak, Przemys\u0142aw Radzik, and Arkadiusz Cichocki.<\/p>\n
Prosecutors seek to charge them with participation in an organized criminal group operating against judges, primarily from “Iustitii,” using positions for illegal data processing, document leaks, and defamatory social media campaigns to discourage criticism of judicial reforms.<\/p>\n
In October of last year, the Supreme Court’s Professional Liability Chamber adjourned Iwaniec’s case to resolve a legal question regarding the rightful disciplinary spokesperson, following the attendance of both Tomasz \u0141adny and dismissed spokesperson Piotr Schab.<\/p>\n
