The District Prosecutor’s Office in Warsaw has appealed a court ruling that acquitted a 25-year-old soldier of exceeding his powers and endangering lives during an incident near the Belarusian border. <\/p>\n
In late May, the Garrison Military Court in Lublin acquitted Karol S. of charges regarding the abuse of authority and exposing individuals to direct danger of death or severe health impairment. The 25-year-old soldier had previously pleaded not guilty to the charges against him.<\/p>\n
The non-final verdict was appealed by the District Prosecutor’s Office in Warsaw, which conducted the initial investigation. Prosecutor Piotr Skiba confirmed that the appeal has been accepted and forwarded to the District Military Court in Warsaw for review.<\/p>\n
During the verdict announcement, Judge Rados\u0142aw Hunek argued that the soldier’s behavior did not violate any regulations and that he was executing his duties in accordance with the law. He emphasized that soldiers have a constitutional obligation to defend the homeland and are authorized to use direct coercive measures and weapons adequately to threats.<\/p>\n
Defense attorney Edyta Skwira stated that the prosecution’s appeal is merely a polemic against the court’s findings and judgment, noting that they are currently awaiting the hearing date. According to the Warsaw District Prosecutor’s indictment, the incident occurred on March 25, 2024, near Dubicze Cerkiewne, where migrants illegally crossed the border by using a car jack to bend steel barrier spans. The accused soldier fired a total of 12 service weapon shots along the border road toward a group consisting of migrants, Border Guard officers, and soldiers.<\/p>\n
Investigators stated that three bullets ricocheted off a concrete post, the ground, and barbed wire, while the remaining nine flew past the group. Prosecutors noted that the non-ricocheting bullets possessed enough energy to cause injury or death along their entire flight path, while the defense maintained that the shots were merely warning measures directed into the air.<\/p>\n
Throughout the investigation and trial, the private soldier from the 1st Warsaw Armored Brigade maintained his innocence, explaining that he yelled warnings before firing safe, alarm shots to alert neighboring posts.
