The Polish Ombudsman has intervened over the lack of legal enforcement tools following numerous complaints from disabled individuals regarding denied entry with assistance dogs. <\/p>\n
The presence of animals in public spaces generates increasing emotion, yet it would seem this does not apply to assistance dogs for people with disabilities. Given the role they play, they should undeniably be met with recognition and respect. As it turns out, however, the reality is different.<\/p>\n
Public debate systematically returns to what dogs should and should not be allowed to do and their place in society. Recently, a fierce debate has also been taking place in social media about whether dogs should ride trains, and if so, under what conditions. A common element of these debates is that at some stage it is stated that assistance dogs for disabled people are naturally exempt from this scrutiny.<\/p>\n
On July 3, 2026, the Ombudsman’s website posted an entry concerning the problems and barriers daily faced by people with disabilities who use assistance dogs. This is based on complaints reaching the Ombudsman regarding refusals of entry to restaurants, parks, or healthcare facilities. As noted in the entry, the main problem in the analyzed situations is not a lack of regulations, but their ineffectiveness.<\/p>\n
Current regulations grant specific rights to disabled people while failing to provide tools that would allow them to be actually enforced. In particular, there is a lack of sanctions for refusing entry to a person with an assistance dog or for imposing broader obligations on such a person than those resulting from current regulations. In response to complaints, the Ombudsman sent a letter to the Government Plenipotentiary for Disabled People at the Ministry of Family, Labor and Social Policy, asking him to address the problem and consider appropriate legislative action.<\/p>\n
Let us recall that under Article 20a of the Act of August 27, 1997, on professional and social rehabilitation and employment of disabled persons, a person with a disability accompanied by an assistance dog has the right of entry to public utility facilities, parks, nature reserves, beaches, and public transport. An assistance dog means a suitably trained and specially marked dog, in particular a guide dog for a blind or visually impaired person and an assistance dog for a person with a motor disability.<\/p>\n
The condition for exercising this right is equipping the assistance dog with a harness and the person with a disability possessing a certificate confirming the status of the assistance dog and a certificate of required veterinary vaccinations. According to Article 20a paragraph 6 of the rehabilitation act, a person with a disability is not obliged to put a muzzle on an assistance dog or lead it on a leash.<\/p>\n
