Although the ministry insists the goal of the changes was to combat the gray economy and tax abuses, entrepreneurs and some experts point out that in practice, the system hit legally operating small businesses the hardest.<\/p>\n<p>The SENT system, previously used mainly to monitor the transport of so-called sensitive goods, covered clothing and footwear on March 17, 2026. The reporting obligation arose already upon the transport of 10 kg of clothing or 20 pairs of shoes. Entrepreneurs had to register transports in the PUESC system, transmit reference numbers to carriers, use GPS localization, and confirm receipt of goods. High administrative sanctions were provided for violating obligations, which in certain cases could reach 46 percent of the value of the transported goods, not less than 20,000 PLN.<\/p>\n<h4>Criticism from SMEs<\/h4>\n<p>However, doubts are raised by the effects of the system&#8217;s operation. According to data presented by the Ministry of Finance, in the first four weeks of SENT functioning for clothing and footwear, about 55,000 transport declarations were recorded, 653 inspections were carried out, and 86 irregularities were detected. Data indicate that irregularities were found in a relatively small part of the inspected transports, while the costs of adapting to the new obligations were borne by the entire industry.<\/p>\n<p>The most reservations were reported by small entrepreneurs running market trade and owners of small family businesses. They criticized the necessity of weighing goods each time, maintaining additional documentation, and monitoring transports. In their opinion, the regulations were created to combat large import abuses, but in practice, they covered primarily the smallest entities that do not have extensive administrative facilities.<\/p>\n<h4>Ministry Limits Reporting Requirements<\/h4>\n<p>Following protests by entrepreneurs, the intervention of the SME Ombudsman, and the analysis of data gathered in the SENT system, the Ministry of Finance decided to limit reporting requirements for the clothing and footwear industry. In a statement on June 19, the ministry reported that domestic sales, export, and most intra-Community supplies were excluded from the reporting obligation, leaving the monitoring obligation primarily for import, transit, and transports recognized as most exposed to tax irregularities. At the same time, reporting thresholds were raised from 10 to 31.5 kg for clothing and from 20 to 64 pieces in the case of footwear.<\/p>\n<h4>Throwing the Baby Out with the Bathwater<\/h4>\n<p>The Ministry of Finance emphasizes that the changes are the result of analyzing the functioning of the system and dialogue with industry representatives. According to critics, however, the limitation of obligations confirms that the original regulations had too broad a scope and covered significantly more entrepreneurs than was necessary to achieve the fiscal goal.<\/p>\n<p>Despite the June easing of regulations, the dispute remains unresolved. Entrepreneurs point out that high sanctions for violating regulations still apply, and companies penalized in the period from March to June have not waited for any form of compensation. As a result, the discussion about SENT increasingly goes beyond tax issues and concerns the boundaries of state control and the question of whether the fight against abuses can justify imposing such far-reaching obligations on all entrepreneurs participating in the turnover of goods.<\/p>\n<p>According to opponents of the system, this very question remains most important today. Similar doubts also appeared during discussions about expanding SENT to subsequent groups of goods.
