Lawyer Adam Gomo\u0142a announced on Monday that he submitted a motion to the Regional Court in Warsaw to lift the European Arrest Warrant issued against former RARS president Micha\u0142 Kuczmierowski. He explained that the goal is to remove from legal circulation a decision that, in his view, no longer has any justification.<\/p>\n
Attorney Adam Gomo\u0142a stated on platform X that “Micha\u0142 Kuczmierowski is staying in the United Kingdom, complying with the obligations imposed on him and calmly waiting for the conclusion of the extradition proceedings conducted against him.” He reported that he sent the application to the Warsaw Regional Court.<\/p>\n
The defense wants the European Arrest Warrant for Kuczmierowski to be lifted. He recalled that “the United Kingdom does not belong to the EU, therefore the premise of Article 607a of the Code of Criminal Procedure has lost its relevance, according to which a condition for using the EAW is the suspicion that a given person is staying in the territory of an EU member state.”<\/p>\n
“An analogous factual situation recently decided against taking into account the request for an EAW against Zbigniew Ziobro,” he wrote on the platform X. He pointed out that “the scope of the application did not cover the arrest warrant covering the United Kingdom.” “The application is justified solely by the necessity of eliminating from legal circulation a ruling that is pointless,” he added.<\/p>\n
Micha\u0142 Kuczmierowski was the president of RARS between 2021 and 2023. In August 2024, the National Prosecutor’s Office announced that in the investigation regarding irregularities in the Agency, it issued a decision to present charges against him and Pawe\u0142 S. \u2013 the creator of the Red is Bad brand. This concerns participation in an organized criminal group, failure to fulfill duties, and exceeding powers to achieve financial benefits. The whereabouts of both suspects were unknown at the time.<\/p>\n
The prosecutor’s office is investigating, among other things, whether special regulations based on the Act on Strategic Reserves were abused in RARS to bypass the public procurement procedure. According to investigators, certain business entities were treated preferentially, and excessively high prices for goods were accepted, including power generators, protective masks, and other goods intended for combating the COVID-19 pandemic. Investigators also revealed that RARS concluded some transactions despite the negative stance of the Central Anti-Corruption Bureau.<\/p>\n
At the beginning of September 2024, Kuczmierowski was detained in London at the request of Polish authorities. The arrest warrant was possible based on the post-Brexit agreement between the EU and the United Kingdom.<\/p>\n
Initially, the court three times rejected defense motions for Kuczmierowski to be released on bail, but in February 2025, it decided he could leave Wandsworth prison in southwest London upon meeting several conditions, such as regular reporting to a police station and paying a financial bail.<\/p>\n
On February 10, 2025, Kuczmierowski was released from custody. In June of this year, the conditions for the suspect’s stay at liberty were modified so that he could travel to Newcastle, though it remains unknown why such a modification was necessary.<\/p>\n
On July 16 of this year, the Court of Appeal in Warsaw once again dismissed the appeal against the decision of the Warsaw Regional Court, which did not grant the request for a letter of safe conduct for Micha\u0142 Kuczmierowski.
