Newly sworn Constitutional Tribunal judge S\u0142awomir Patyra announced he will refuse to participate in any judicial procedures until barred judges are allowed to work. <\/p>\n
Karol Nawrocki received the oath from the new judge of the Constitutional Tribunal on Tuesday, July 28. On the same day, Dr. Habil. S\u0142awomir Patyra appeared in front of the TC headquarters accompanied by four judges who were chosen in March. These were Magdalena Bentkowska and Dariusz Szostek, who were sworn in by the president and thus admitted to adjudicating, as well as Anna Korwin-Piotrowska and Krystian Markiewicz, who were not sworn in and not admitted to adjudicating, a group that also includes Maciej Taborowski and Marcin Dziurda.<\/p>\n
S\u0142awomir Patyra stated that he stands in solidarity with the TC judges who are unlawfully deprived of the opportunity to participate in the Tribunal’s work. He declared that for this reason, he will not participate in any procedures related to adjudicating in the Constitutional Tribunal or in other proceedings related to organizational matters concerning the TC until these judges are able to adjudicate.<\/p>\n
Patyra emphasized that he intends to submit a statement refusing to adjudicate because he cannot imagine taking an oath today to uphold the constitution and breaking it from tomorrow, which is entirely inconsistent with his convictions on what the ethos of a Constitutional Tribunal judge should look like.<\/p>\n
The judge added that together with the TC members chosen in March by the Sejm, he forms a team of TC judges who are fully mobilized to restore the Constitutional Tribunal to its proper, constitutional, and systemic shape. He assured that knowing the professional biographies of these judges, he has no doubt they will provide added value regarding a substantive approach to matters as important as preserving the guarantees of a legal state.<\/p>\n
Patyra also stated that he took the oath in the Presidential Palace, but before the nation. He pointed out that the oath formula clearly states he vows to remain faithful to the nation and to stand guard over the constitution, expressing no doubt that all the people standing with him, as well as those who could not appear for objective reasons, fully share this standard.<\/p>\n
Dr. Habil. S\u0142awomir Patyra is a constitutionalist associated with Maria Curie-Sk\u0142odowska University in Lublin since 1994, where he has served as the head of the Department of Constitutional Law at the Faculty of Law and Administration since 2019. He has also worked at the Kazimierz Pu\u0142aski Radom University since 2013, serves as an academic lecturer, co-author of several textbooks, and member of the Polish Constitutional Law Association, among others. Patyra has been a legal advisor and member of the District Chamber of Legal Advisors in Lublin since 2013, cooperating with the National Council of Legal Advisors since that time.<\/p>\n
He is the third TC judge whose oath was received by President Nawrocki, following Magdalena Bentkowska and Dariusz Szostek in April. However, President Nawrocki has not received the oath from the remaining four individuals chosen as TC judges by the Sejm in March: Maciej Taborowski, Marcin Dziurda, Krystian Markiewicz, and Anna Korwin-Piotrowska. Representatives of the Chancellery of the President of the Republic of Poland indicated in April that the situation of these four people is being analyzed because, according to the presidential chancellery, errors occurred in the Sejm.<\/p>\n
The issue of the president not receiving the oath from the four TC judges chosen in March raises controversies in the legal community.
