Senior caregivers will not be able to provide services under previous conditions starting August 5, 2026. The amendment to the Social Assistance Act introduces new requirements for individuals providing home care, requiring additional conditions to be met, while currently working caregivers will receive a specific timeframe to fulfill the missing requirements.<\/p>\n
The law clarifies the scope of care services, which primarily include assistance with daily living needs, hygienic care, and doctor-prescribed nursing within the scope of non-specialized knowledge. Services should also ensure contact between the recipient and their surroundings as much as possible, while specialized care services continue to be provided by professionals adapted to specific health conditions or disabilities.<\/p>\n
New regulations exclude family members of the care recipient from performing official care services under the social assistance system. This does not ban family help in general, but specifically applies to individuals performing care services under the meaning of the social assistance act.<\/p>\n
Changes also apply to individuals providing neighborhood assistance services, who will now face specific requirements. Meanwhile, municipalities gain the obligation to monitor service quality and respond to identified irregularities.<\/p>\n
Current senior caregivers must also adapt to the new rules within specific deadlines. Those who have not previously submitted a declaration of psychophysical capacity must do so within one month of the regulations entering into force, by September 5, 2026.<\/p>\n
Individuals who have not completed first aid training will be allowed to continue providing services for three months after the law enters into force, until November 5, 2026, after which completing the first aid training becomes mandatory.<\/p>\n
The amendment enters into force on August 5, 2026, but President Karol Nawrocki decided to refer it to the Constitutional Tribunal for subsequent review despite signing it. The referral stems from doubts regarding the law’s compliance with local government autonomy due to new municipal obligations without a comprehensive financing system.<\/p>\n
However, referring the law to the Constitutional Tribunal does not suspend its application. Until a potential ruling is issued, the regulations remain in force and municipalities as well as care providers must apply them.<\/p>\n
