The Ministry of Labor pointed out that the previous definition of mobbing was over 20 years old, complicated, and difficult to apply, with statistics showing employees won only 10 percent of such court cases. The new amendment simplifies the definition so that mobbing constitutes recurring, repeating, or constant behaviors originating from a supervisor, coworker, subordinate, individual, or group.<\/p>\n
These actions can be physical, verbal, or non-verbal, and recognition as mobbing is independent of the perpetrator’s intent or specific consequences. Employees who experience mobbing gain the right to seek compensation from the employer of no less than six times the minimum wage, while employers are required to establish clear anti-mobbing rules, procedures, and preventive measures.<\/p>\n
The amendment also clarifies regulations regarding discrimination, defining it to include situations where an employee is or could be treated less favorably than others, as well as harassment that violates employee dignity.
