The amount is not fixed and depends, among other things, on the number of hours worked in a given month. The August balance provides 160 hours, which translates to nearly 1,000 PLN gross of additional compensation. Importantly, employers cannot refuse to pay this benefit nor replace it with a bonus or another supplement.<\/p>\n<p>The night shift allowance applies to every employee employed under an employment contract who performs duties during night hours. It is a mandatory component of remuneration resulting directly from the provisions of the Labor Code, meaning employers cannot waive it or make its payment dependent on their own decision.<\/p>\n<h4>Definition of Night Hours<\/h4>\n<p>According to regulations, the night time covers eight consecutive hours between 9 PM and 7 AM. However, the specific hours applicable in a given workplace are determined by the employer in the work regulations, collective labor agreement, or other internal regulations.<\/p>\n<p>In practice, this means that in one company, night hours may apply from 9 PM to 5 AM, in another from 10 PM to 6 AM, and in yet another from 11 PM to 7. AM. Other solutions are also permissible as long as they fall within the limits defined by regulations.<\/p>\n<h4>Higher Allowance in August<\/h4>\n<p>The amount of the night work allowance changes almost every month due to a simple mechanism specified in regulations. The basis for its calculation is the minimum wage for work and the number of hours to be worked in a given month.<\/p>\n<p>As of January 1, 2026, the minimum wage is 4,806 PLN gross. In August, the nominal working time is 160 hours, meaning the allowance for one hour of night work will amount to 6.01 PLN gross.<\/p>\n<p>This is higher than in July when, due to a greater number of working hours, the allowance was 5.22 PLN gross per hour. The fewer hours there are to work in a given month, the higher the rate of the allowance for each hour of night work.<\/p>\n<p>An employee performing work exclusively during night hours may receive a maximum of 961.60 PLN gross in additional pay in August.<\/p>\n<h4>Prohibition of Replacing the Bonus<\/h4>\n<p>The night work allowance is a mandatory element of remuneration. Employers have no right to omit, reduce, or replace it with another benefit, such as a discretionary bonus or motivational supplement.<\/p>\n<p>The only exception applies to employees permanently performing work outside the workplace. In their case, it is possible to establish a lump sum for night work, which must nevertheless correspond to the expected number of hours worked at night and compensate for the due allowance.<\/p>\n<h4>Night Shift Allowance Schedule for 2026<\/h4>\n<p>The amount of the allowance depends on the number of working hours falling in a given month. In 2026, it is as follows:<\/p>\n<p>January: 160 working hours, allowance of 6.01 PLN gross per hour<\/p>\n<p>February: 160 working hours, allowance of 6.01 PLN gross per hour<\/p>\n<p>March: 176 working hours, allowance of 5.46 PLN gross per hour<\/p>\n<p>April: 168 working hours, allowance of 5.72 PLN gross per hour<\/p>\n<p>May: 160 working hours, allowance of 6.01 PLN gross per hour<\/p>\n<p>June: 168 working hours, allowance of 5.72 PLN gross per hour<\/p>\n<p>July: 184 working hours, allowance of 5.22 PLN gross per hour<\/p>\n<p>August: 160 working hours, allowance of 6.01 PLN gross per hour<\/p>\n<p>September: 176 working hours, allowance of 5.46 PLN gross per hour<\/p>\n<p>October: 176 working hours, allowance of 5.46 PLN gross per hour<\/p>\n<p>November: 160 working hours, allowance of 6.01 PLN gross per hour<\/p>\n<p>December: 160 working hours, allowance of 6.01 PLN gross per hour<\/p>\n<h4>Restrictions on Night Work<\/h4>\n<p>Labor Code regulations also provide restrictions regarding the performance of work during night hours. Pregnant women and juveniles under the age of 18 are prohibited from performing night work.<\/p>\n<p>Special protection is also granted to employees raising a child up to the age of 8, who may only work at night if they give their consent.<\/p>\n<p>Restrictions also apply to people with disabilities.
