The Ministry of Labor has prepared changes aimed at better protecting employees from the effects of high temperatures. This is a reaction to increasingly frequent heatwaves and the growing health risks for people performing duties both indoors and outdoors. The regulation specifies not only temperature limits, but also the catalog of actions an employer must implement when conditions become too difficult.<\/p>\n
According to “Portal Samorz\u0105dowy,” the new regulations define the maximum permissible temperatures in the workplace and the thresholds above which the employer must take specific actions more clearly than ever before. The new regulations introduce two temperature levels.<\/p>\n
Once the indicated thresholds are reached, mere observation of the situation will not suffice. The employer will be obliged to apply technical or organizational solutions that reduce the risk for employees. In practice, this may mean shortening working hours, introducing additional breaks, or changing the hours of duty. Importantly, such decisions are to be consulted with the employees.<\/p>\n
The new regulations will enter into force on January 11, 2027, and employers will receive six months to adapt to the new requirements. However, the Ministry recalls that employers are currently responsible for ensuring safe and hygienic working conditions. Therefore, the protection of employees’ health and life does not begin only with the entry into force of the new regulations.<\/p>\n
The new regulation organizes the rules of work during heatwaves and clearly defines temperature limits for the first time, after which the employer must act. In extreme conditions, work can be suspended, and companies will be obliged to introduce solutions protecting employees.
