The Ministry of Family, Labor, and Social Policy wants to solve a problem that people drawing early retirements and then moving on to general retirement have struggled with for years. If the project enters into force, ZUS is to automatically recalculate the benefits of nearly 200,000 affected seniors.<\/p>\n<p>However, the project does not mean full compensation for everyone. Some retirees will receive a higher benefit only from 2027 onwards, and the issue of compensation for past years still raises discussion.<\/p>\n<h4>Why Did the Government Prepare New Regulations?<\/h4>\n<p>The history of this change begins over a decade ago. In 2013, regulations came into life that ordered the reduction of the calculation base for the general retirement by the amounts of previously drawn early retirements. As a result, many people who ended their professional activity earlier in accordance with the rules in force at that time received benefits lower than what would result from the capital accumulated in their ZUS account after reaching the universal retirement age.<\/p>\n<p>The problem went to courts for years, and successive rulings showed that some seniors might have been treated unfavorably. Now, MRPiPS proposes a statutory solution that is to cover a significant group of retirees without the need for individual proceedings. According to the project&#8217;s assumptions, the changes are to concern about 196.5 thousand people, of which over 135 thousand currently draw underestimated benefits.<\/p>\n<h4>Who Will Get a Higher Pension From ZUS?<\/h4>\n<p>The project does not cover all retirees. The ministry points to specific groups of people who will benefit from the new recalculation rules. This group most often feels the effects of the regulations in force since 2013. However, the amount of the raise will not be identical. Everything depends on the insurance history, the amount of accumulated capital, and the moment of transition to early and universal retirement.<\/p>\n<h4>What Does the Raise Depend On?<\/h4>\n<p>The highest amount appearing in government simulations is 552 PLN gross per month, but this is an example of one individual situation. In many cases, the raise will be lower and may amount to several dozen or several hundred zlotys. The resort plans to apply a special correction factor that will allow increasing currently paid benefits. The final amount will be calculated individually by ZUS, which is why people belonging to the same cohorts may receive completely different raises. At this stage, the project is in the legislative process, so the details of the mechanism may still change.<\/p>\n<h4>Examples of Projected Pension Increases<\/h4>\n<p>The ministry showed sample calculations that clearly illustrate the scale of the planned changes. The differences are distinct, though not every retiree will receive the same raise. Everything depends on the moment of transition to early retirement, the amount of accumulated contributions, and the date of granting the universal retirement.<\/p>\n<p>Man from the 1954 cohort: 552 PLN gross. Woman from the 1949 cohort: 393 PLN gross. Man from the 1950 cohort: 303 PLN gross. Woman from the 1957 cohort: 89 PLN gross.<\/p>\n<p>These are only simulations prepared for the needs of the project. In individual cases, the amount of the increase can be both lower and higher than the presented examples. The final calculations will be carried out by ZUS based on data recorded on the insured person&#8217;s account.<\/p>\n<h4>Real-Life Example: Why Two People From the Same Cohort May Get Different Raises<\/h4>\n<p>Let us imagine two women born in 1957 who went on early retirement a few years ago. Both belong to the same age group, but one worked full-time with high contributions for most of her career, while the other performed part-time work for many years and had longer employment breaks.<\/p>\n<p>Although both will be covered by the new regulations, the amount of the pension increase may differ significantly. This results from the design of the pension system, which is based primarily on accumulated pension capital and insurance history rather than solely on the year of birth. Therefore, the amounts provided by the ministry should be treated as examples rather than a guaranteed amount of a future raise.<\/p>\n<h4>Deadlines, Payments, and Application Requirements<\/h4>\n<p>One of the most important pieces of information for retirees is the method of implementing the changes. The project assumes that the recalculation of benefits will take place ex officio, so people covered by the new regulations will not have to submit additional applications or complete documents. The current schedule provides for the recalculation to start from April 1, 2027, and the first higher benefits to reach seniors from May 2027.<\/p>\n<p>Such a solution is intended to limit the number of administrative proceedings and accelerate the implementation of changes. For many seniors, this will be the first raise resulting from the correction of the pension calculation method rather than annual indexation.<\/p>\n<h4>Recalculation Without Compensation and Key Controversies<\/h4>\n<p>Although the ministry&#8217;s proposal is assessed as a step towards solving a long-term problem, experts point out that the project does not meet all expectations of people harmed by previous regulations. Most questions concern three issues, with the lack of compensation for past years generating the greatest debate. Over recent years, some retirees have successfully claimed their rights in courts, obtaining a more favorable settlement of benefits.<\/p>\n<h4>Government Expenditures and Reform Costs<\/h4>\n<p>According to estimates presented by the Ministry of Family, Labor, and Social Policy, the cost of the new solutions in the first year of operation is to be about 400 million PLN. Over a ten-year perspective, state expenditures related to the increase of benefits are to exceed 7 billion PLN. The resort argues that this is the price for tidying up a multi-year dispute regarding pension calculation rules and ensuring more uniform treatment of people in similar situations.<\/p>\n<h4>What Should Seniors Do?<\/h4>\n<p>People who suspect that the new regulations may cover them do not need to take any action for now. The project assumes automatic recalculation of benefits, so no additional applications to ZUS are provided at the current stage. However, it is worth keeping all decisions regarding early and universal retirement.<\/p>\n<h4>Frequently Asked Questions<\/h4>\n<p>The project covers people who drew early retirement before June 6, 2012, and belong to the cohorts indicated in the act. There is no need to submit an application to ZUS for pension recalculation. If the bill is passed without major changes, recalculations will start from April 1, 2027, with higher payments reaching seniors from May 2027. The current version of the project does not provide for the payment of compensation for the period when benefits were calculated according to previous rules.
