Following an incident where a farmer destroyed roughly 200 meters of newly paved road with a tractor, Gliwice authorities have dismissed his claims to the land as entirely unjustified. <\/p>\n
On Friday, August 7, a farmer drove a tractor with a plow onto newly laid asphalt, destroying about 200 meters of the road. The man was arrested for three months, as previously reported by Gazeta.pl. The prosecutor charged him with destruction of property of significant value, which carries a penalty of one to ten years in prison. A video recording capturing the farmer’s actions was published on Facebook by Gliwice Mayor Katarzyna Kuczy\u0144ska-Budka.<\/p>\n
The farmer claims that the road runs through his property and that the work conducted there is illegal. However, Mariusz Kope\u0107, spokesperson for the Gliwice City Hall, told Wyborcza that the city has owned the land where the road is located since 2001.<\/p>\n
The property became municipal property based on Article 98 of the Real Estate Management Act, initiated at the request of the property owner himself\u2014the very same individual who plowed up the fresh surface. He requested the separation of two plots of land designated for a road, which subsequently passed by law into municipal ownership, as confirmed by land and mortgage register entries. Claims that the road area still constitutes his property therefore lack legal basis, Kope\u0107 stated.<\/p>\n
Maps have been published online claiming to show that the road also occupied a green belt. Orthophotomaps available online only show the actual use of the area on the day the photos were taken and do not reflect the legal status of the land for plots No. 803 and 804 in Ostropa, the Mayor of Gliwice told Wyborcza.<\/p>\n
The strip of land belonging to the municipality is wider than the area actually occupied by the road.
