Warsaw prosecutors have launched an official investigation into the unauthorized online publication of a video and audio recording documenting the witness interrogation of PiS leader Jaros\u0142aw Kaczy\u0144ski. <\/p>\n
The Warsaw-Praga District Prosecutor’s Office has initiated an investigation into the unlawful public disclosure of a video recording from the interrogation of PiS leader Jaros\u0142aw Kaczy\u0144ski in the “two towers” case. The materials were handed over to the Praga unit by the Regional Prosecutor’s Office in Warsaw after the completion of verification activities.<\/p>\n
Following the conclusion of verification proceedings, an investigation was launched on Tuesday, August 11, regarding the public dissemination of information from preparatory proceedings on July 27, 2026, and August 3, 2026, as announced by the spokesperson for the Warsaw-Praga District Prosecutor’s Office, Prosecutor Marzena Kie\u0142ek-\u0141opi\u0144ska.<\/p>\n
The spokesperson explained that the disclosure of the materials occurred through the publication on YouTube of an audio-video recording documenting the witness interrogation without the consent of the body conducting the proceedings, as well as the publication of a link to these materials in articles on the goniec.pl website. Prosecutor Kie\u0142ek-\u0141opi\u0144ska emphasized that due to the seriousness of the case and high public interest, the proceedings are being conducted as an investigation, and the act carries a penalty of up to two years of imprisonment.<\/p>\n
The Warsaw district prosecutor’s office previously noted that the only person who requested access to the full case file was one of the victim’s legal representatives, who had been formally instructed regarding Article 241 of the Penal Code concerning the preservation of investigation secrecy.<\/p>\n
Considering that attorney Giertych had the opportunity and is actively involved in criticizing the actions of the prosecution, particularly the decisions made by prosecutor Ma\u0142gorzata Szeroczy\u0144ska, our stance is what it is, said PAP spokesperson for the District Prosecutor’s Office in Warsaw, Prosecutor Piotr Antoni Skiba. He also added that investigators do not see any other person who would have a reason to dispose of the evidentiary material in such a manner.<\/p>\n
Attorney Roman Giertych, representing the Austrian businessman, addressed the allegations, rejecting insinuations about his involvement in leaking the recordings. First of all, the prosecution had access to the files. In my opinion, the leak in the Jaros\u0142aw Kaczy\u0144ski case comes from the prosecution, stated attorney Roman Giertych in an interview with Fakt.<\/p>\n
The matter was also raised during a press conference by Prime Minister Donald Tusk. The head of government noted that he did not get the impression that the prosecution had officially prejudged the guilt of the KO MP. However, he stipulated that if it is established that documents or interrogation recordings were illegally removed, no one will escape accountability. If it turns out that Giertych broke the law, he will face the consequences, stated the Prime Minister.<\/p>\n
Jaros\u0142aw Kaczy\u0144ski was heard as a witness on June 10, and recordings of this several-hour procedure appeared online at the end of July. Two weeks after he gave his testimony\u2014on June 25\u2014the prosecution decided to discontinue the proceedings due to the lack of features of a prohibited act. The investigation, conducted since February 2025, concerned the suspicion of leading Austrian entrepreneur Gerald Birgfellner to an unfavorable disposition of property in the amount of at least 1.3 million euros by persons representing the Srebrna company associated with PiS during plans to build skyscrapers in Warsaw.
