On Tuesday, August 11, Poland’s Supreme Court waived the immunity of judge Pawe\u0142 B., who was caught driving under the influence with over two permilles of alcohol in his system. <\/p>\n
The Supreme Court on Tuesday, August 11, granted the National Prosecutor’s Office’s request to waive the immunity of Pawe\u0142 B. “At the same time, he suspended the judge from official duties for the duration of the proceedings and reduced his salary by 50 percent for the duration of the suspension,” stated National Prosecutor’s Office spokesperson Prosecutor Przemys\u0142aw Nowak.<\/p>\n
The prosecutor’s office charged the Szczecin judge with driving a vehicle while intoxicated. During the interrogation, Pawe\u0142 B. confessed to the crime and refused to make a statement. The judge faces up to three years in prison.<\/p>\n
“The prosecutor applied a preventive measure against the suspect in the form of an order to refrain from driving mechanical vehicles for the duration of the proceedings and a financial bail in the amount of 10,000 PLN. Pawe\u0142 B.’s driving license was confiscated, and his car was temporarily seized,” informed Prosecutor Nowak.<\/p>\n
The incident occurred on August 9, when the Szczecin Regional Court judge was driving a BMW in Gryfino and subsequently on provincial road No. 120 towards We\u0142tyno. Around 9:30 PM, a random witness who suspected the driver might be intoxicated noticed him and informed the police.<\/p>\n
Gryfino police officers detained the judge and established that he had 2.1 permilles of alcohol in his exhaled breath. The officers transported Pawe\u0142 B. to the hospital, where blood was drawn. “Chemical and toxicological tests showed 1.81 permilles and 1.61 permilles of ethyl alcohol in the blood, respectively. A state of intoxication occurs when the blood alcohol content exceeds 0.5 permilles,” the prosecutor stated.<\/p>\n
A judge cannot be detained or held accountable without the permission of the Supreme Court’s Professional Liability Chamber. However, this does not apply to detention in the event of catching a judge in the act of committing a crime, if detention is necessary to ensure the proper course of proceedings, which was the case with Pawe\u0142 B.<\/p>\n
