A former miner from Jaworzno has won a nearly two-decade legal battle against the Social Insurance Institution (ZUS). The court ruling mandates both a one-time retroactive payment and an increase in his ongoing monthly pension.<\/p>\n
The dispute centers on a mechanism that reduced pension capital by the amount of benefits already paid out. After 18 years of litigation, the appellate court upheld a lower court\u2019s decision, confirming the claimant’s rights.<\/p>\n
The issue affects far more than just former miners. Estimates suggest up to 200,000 people may be entitled to corrections, including teachers who retired early in the early 2000s.<\/p>\n
Those most affected include women born between 1949 and 1959, and men born in 1949, 1950, 1951, 1952, and 1954. For many, these calculation errors resulted in financial losses of up to 1,000 PLN per month.<\/p>\n

In the case of the miner from Jaworzno, his pension capital was reduced by 125,000 PLN. Consequently, his monthly pension was calculated at 1,230 PLN instead of the 2,100 PLN he was entitled to.<\/p>\n
Following the final verdict, he received an 18,000 PLN retroactive payment. His monthly benefit has since been adjusted to over 3,000 PLN gross.<\/p>\n
The government has prepared draft legislation to address these pension irregularities systematically. The proposal would allow for the recalculation of benefits for those affected, though it does not provide for full retroactive compensation.<\/p>\n
Full compensation would cost the state budget an estimated 8\u20139 billion PLN annually. Despite completing public consultations, the project remains stuck, leaving thousands of retirees waiting for a definitive solution.<\/p>\n
