The European Arrest Warrant (EAW) is valid only when there is a reasonable suspicion that the wanted individual is present within the European Union. Judge Tomasz Grochowicz, who has been overseeing the case for a week, has requested urgent clarification from the prosecution on whether Ziobro remains in Hungary or any other EU member state, or if investigators have knowledge of him leaving the Schengen area.<\/p>\n
According to RMF FM reporter Tomasz Skory, the prosecution’s response may determine the future of the proceedings. Under Article 607a of the Code of Criminal Procedure, an EAW can only be issued if the suspect is suspected of being in an EU country.<\/p>\n
The prosecution has publicly stated that Ziobro is in the United States, specifically in Washington state. Investigators have already prepared an extradition request for him from the US. If the court confirms that Ziobro is outside the EU, the current EAW proceedings could be dismissed or the prosecution’s motion rejected, as the EAW is designed solely for cooperation between EU member states.<\/p>\n
The former minister reportedly left Europe on May 9. Both the prosecution and other parties to the case were reportedly aware of his change in location. Additionally, defense attorney Bartosz Lewandowski has submitted an original statement from his client confirming his presence in the United States to the court.<\/p>\n
Dismissing the EAW proceedings does not mark the end of efforts to bring the former minister to Poland. If he is indeed in the US, the appropriate legal procedure is an extradition request, which the prosecution has already prepared.<\/p>\n
In February, the District Court for Warsaw-Mokot\u00f3w approved a request for the temporary arrest of Ziobro. The former Justice Minister is a suspect in an investigation regarding irregularities within the Justice Fund, with prosecutors alleging he committed a total of 26 crimes.<\/p>\n
Investigators accuse him of ordering subordinates to break the law, interfering with tender preparation, and facilitating the granting of funds to ineligible entities. Ziobro denies these charges, characterizing the actions taken against him as politically motivated.<\/p>\n
