The Territorial Defense Force (WOT) represents the fifth branch of the Polish Armed Forces. Soldiers serve in either professional or voluntary capacities, with the latter, known as Territorial Military Service (TSW), designed to allow for the integration of civilian employment with military duties.<\/p>\n
Because the force is regionally based, soldiers serve near their homes. Regulations ensure that the roles of employee and soldier are effectively balanced, defining specific rights and obligations for both parties.<\/p>\n
From the moment a summons is issued until the service ends, an employer is prohibited from terminating an employee’s contract. This protection is limited; it does not apply during disciplinary dismissals or in the event of company liquidation or bankruptcy.<\/p>\n
While training generally occurs on weekends, continuous training requires the employer to grant unpaid leave. During this time, the employee retains all labor rights, except for salary, and the period counts toward their total seniority.<\/p>\n
When soldiers are directed to specific courses or professional training, employers must grant time off and provide payment. However, these costs are recoverable. Employers can request reimbursement by submitting expenditure records and employment contracts to the Military Recruitment Center commander, who processes payments within 14 days.<\/p>\n
A major change took effect on November 12, 2024, as the legal requirement for employers to pay two weeks’ worth of salary as severance to those joining the TSW was repealed. This change was introduced to support entrepreneurs employing Territorial Defense soldiers.<\/p>\n
In place of the former severance pay, the military now provides an initial benefit. This payment equals 50% of the average monthly salary from the second quarter of the previous year.
