The Director of KIS has significantly radicalized the stance that any meaningful discrepancy between these documents can lead to severe consequences for taxpayers.

While there is no obligation to provide a visualization if KSeF is functioning and the invoice was successfully sent to the system, businesses often do so to secure payments. However, this practice creates no legal guarantee and, under the new interpretation, poses a substantial risk.

Compliance Requirements for Visualizations

Taxpayers may generate visualizations through internal software, but these must mirror the content of the structured invoice. Any information present in the XML file must appear identically in the visualization. While non-essential elements like company logos or customer service contacts are permitted, you cannot include additional transaction data on the visualization that is absent from the structured XML file.

Relying on visualizations for essential transaction details—such as payment terms, bank account numbers, or commodity codes—while omitting them from the KSeF-registered XML file is strongly discouraged and inconsistent with current official guidelines.

Risk of Double VAT Taxation

The Director of KIS now maintains that if a PDF visualization contains all key invoice data but deviates from the structured invoice, it may be classified as a separate, redundant invoice. Under Article 108 of the VAT Act, such discrepancies could force businesses to pay VAT twice on the same transaction.

Tax authorities are strictly enforcing the requirement that visualizations must be a faithful reflection of the structured invoice. Any minor detail that differentiates the two documents may now be interpreted as evidence of a second invoice, exposing taxpayers to unnecessary and costly fiscal penalties.

Starting April 2026, the Director of the National Revenue Administration (KIS) has intensified requirements for invoice visualizations, warning that discrepancies between structured XML files and PDF displays could trigger double VAT liabilities.
