From 2025 to 2026, a phased model applies, where the secondary benefit is set at 15 percent. To qualify in 2026, applicants must have reached the statutory retirement age of 60 for women or 65 for men.

Additional requirements include having remained in a legal marriage with shared property until the partner’s death. Furthermore, the right to the survivor’s pension must not have been established more than five years before reaching retirement age, and the total payout must remain within defined financial limits.

Calculating the most profitable benefit structure

The primary rule is that the recipient retains 100 percent of the higher benefit while adding 15 percent of the lower one. For instance, if an individual’s pension is 2,000 PLN and the survivor’s benefit is 3,000 PLN, the total becomes 3,300 PLN. Conversely, if one’s own pension is higher, that is kept in full with 15 percent of the smaller survivor’s benefit added on top.

If both benefits are equal, the total payout increases by 15 percent of the secondary benefit amount. However, there is a hard cap on these combined payments.

Financial limits and ZUS deductions

As of March 1, 2026, the total sum of combined benefits cannot exceed three times the lowest pension amount, currently set at 5,935.47 PLN gross. Any amount exceeding this threshold is forfeited, as ZUS will automatically cap the payout at this limit.

Application process for benefits

To receive the combined payment, applicants must submit the ERWD form to ZUS. This can be done online via the PUE ZUS portal, by registered mail, or in person. If the applicant has not previously claimed a survivor’s pension, they must also submit an ERR form. Once processed, payments commence from the month the correctly completed documents are received.

Future adjustments and automatic increases

On January 1, 2027, the survivor’s benefit indicator will rise from 15 percent to 25 percent. This adjustment will be performed automatically by ZUS without requiring new applications. Government forecasts suggest that the maximum payment threshold will also increase in 2027 to approximately 6,170 PLN gross, pending official inflation-based adjustments.

Eligibility restrictions and denials

ZUS will reject applications if the spouse died before the survivor turned 55 (women) or 60 (men), or if the applicant has not yet reached statutory retirement age. Eligibility is also lost in cases of divorce, judicial separation, or if the survivor enters into a new marriage.

Starting January 2026, Polish retirees can claim a combined benefit consisting of their own pension and a portion of their late spouse’s, provided specific eligibility criteria and financial caps are met.
