The Supreme Administrative Court upheld the refusal, leading the couple to take the case to the ECHR in 2018. The court ultimately ruled that Poland violated the child’s right to private life and prohibition against discrimination, noting the refusal left the child without a Polish identity, passport, or identification number.<\/p>\n
In a separate, similar case involving a British-Polish couple, the ECHR declared the complaint inadmissible. The court found that because the family did not reside in Poland and had no immediate plans to move there, the Polish refusal had only a theoretical impact on their daily lives.<\/p>\n
