Minister of Family, Labor, and Social Policy Agnieszka Dziemianowicz-B\u0105k announced that the largest reform in the history of the State Labor Inspectorate (PIP) takes effect this Wednesday. The agency will now have the administrative tools to convert non-standard “junk contracts” into formal employment contracts to combat long-standing labor market pathologies.<\/p>\n
The scale of these inspections is expected to be significant, as the Ministry has already received numerous complaints from workers. While exact projections for the number of reclassified contracts remain unavailable, the Ministry of Finance estimates that approximately 160,000 B2B contracts are currently masking traditional employment relationships.<\/p>\n
To encourage compliance, employers have until July of next year to utilize a grace period. Business owners who voluntarily correct improper employment practices within this 12-month window will avoid administrative proceedings and fines. Starting July 8, maximum fines for labor law violations will increase from 30,000 to 60,000 PLN, with penalties for repeat offenses reaching up to 90,000 PLN.<\/p>\n
The Minister noted that many entrepreneurs are already auditing their workforce. Those who proactively offer formal labor contracts are effectively increasing worker security without waiting for a potential inspection.<\/p>\n
When an inspector identifies a misclassified civil-law agreement, they may first issue a directive to sign a formal employment contract. If the employer refuses, an administrative proceeding will be initiated. Inspectors will examine factors such as whether the worker has a defined scope of duties, fixed compensation, and a set time and place of work.<\/p>\n
If legal requirements are met, the district labor inspector will issue an administrative decision converting the contract. This decision will define the terms of employment, including salary, position, and contract duration. Employers have the right to appeal these decisions to labor courts, which are mandated to implement fast-track procedures and interim protections to prevent worker termination during legal disputes.<\/p>\n
The reform establishes a new data-sharing framework between the PIP, the Social Insurance Institution (ZUS), and the National Revenue Administration (KAS). These agencies will exchange results from labor inspections and reports of legal violations.
