Poland Cracks Down on Fuel Price Gouging

Poland’s National Revenue Administration (KAS) is actively monitoring and enforcing maximum fuel prices at stations nationwide, resulting in ten identified violations on Tuesday.

Fuel Price Controls Enforced

The National Revenue Administration (KAS) is monitoring adherence to maximum fuel prices set by stations. On Tuesday, ten instances of inflated pricing were identified, according to Deputy Minister of Finance and KAS head, Marcin Łoboda.

KAS utilizes risk analysis to pinpoint price discrepancies. An example cited involved outdated prices displayed on pylons while distributors showed prices compliant with the energy minister’s price announcements.

Inspection Methods and Citizen Reports

KAS officials conducted inspections in each province on Tuesday. Additionally, the agency receives reports from citizens, though these currently represent a small percentage of identified violations.

Electronic systems, specifically online cash registers linked directly to the Ministry of Finance servers, are also aiding in price monitoring, providing real-time sales data.

Penalties for Price Violations

Businesses found to be exceeding maximum fuel prices face potential fines of up to 1 million złoty, though the amount may be adjusted based on the circumstances. Decisions on penalties for the ten violations identified Tuesday will be made by heads of customs and tax offices.

New Regulations and Price Caps

Amendments to the act on oil stockpiles, part of the government’s “Lower Fuel Prices” (CPN) package, came into effect Sunday. These changes established a mechanism for calculating maximum fuel prices.

Under the new rules, fuel retailers are obligated to adhere to maximum prices during periods of reduced VAT rates (effective March 31st). The energy minister publishes daily announcements regarding maximum fuel prices, with sales exceeding these limits subject to fines.

Excise and VAT Reductions

A regulation reducing excise duties on fuels came into effect Monday, lowering excise on gasoline to 1239 zł per 1000 liters, diesel to 880 zł per 1000 liters, and biocomponents to 880 zł per 1000 liters. This regulation is valid until April 15th.

A separate regulation lowering VAT on fuels to 8% is in effect from March 31st to April 30th.

Budgetary Impact of Price Reductions

The Ministry of Finance estimates the excise reduction will cost the budget 700 million złoty monthly, while the VAT reduction will cost 900 million złoty monthly. The CPN package aims to mitigate price pressures, combat inflation, and ensure fuel supply security.

Current Maximum Fuel Prices

As of Wednesday, the maximum price for 95-octane gasoline is 6.21 zł per liter, 98-octane gasoline is 6.81 zł per liter, and diesel is 7.66 zł per liter, according to the energy minister’s announcement. These prices are slightly higher than Tuesday’s rates, with gasoline up 5 gr/l and diesel up 6 gr/l.
