Poland’s Supreme Court ruled on two important social insurance cases in 2025, including partial invalidity of employment contracts.
Partial Invalidity of Employment Contracts
Overestimation of the basis for calculating benefits may be a ground for partial invalidity of an employment contract (ruling of June 24, 2025, ref. III USK 35/25).
Excessive Remuneration and Insurance Risk
An employment contract concluded immediately before the expected occurrence of an insurance risk, in which the established remuneration significantly exceeds the value of the work actually performed, may be deemed invalid – precisely in the part concerning the inflated remuneration – as contrary to the principles of social coexistence.
