Polish Constitutional Tribunal Delays Ruling on Judge Selection

Poland’s Constitutional Tribunal has postponed a hearing regarding the legality of recent parliamentary appointments to the court, requesting the President’s opinion.

PiS Challenges Judge Selection Procedure

A group of Law and Justice (PiS) parliamentarians have challenged the regulations governing the selection of Constitutional Tribunal judges by the Sejm (lower house of parliament), arguing they may be unconstitutional.

The PiS lawmakers, Marcin Warchoł and Michał Wójcik, initiated the challenge, seeking a ruling on the procedure’s constitutionality.

President’s Input Sought

The Constitutional Tribunal, under the leadership of Bogdan Święczkowski, decided to postpone the hearing indefinitely and requested a written statement from President Karol Nawrocki by April 17th.

Święczkowski explained the request stems from a challenge concerning the President’s prerogative to administer the oath of office to the judges.

Potential Impact on Recent Appointments

PiS proposes that if the regulations are deemed unconstitutional, they should lose validity the day before the Sejm’s recent selection of six new judges.

This interpretation could potentially invalidate the recent appointments made by parliament.

Background: Recent Tribunal Appointments

The Sejm recently filled six vacant positions on the Constitutional Tribunal in mid-March, bringing the total number of judges to fifteen.

Candidates were nominated by at least 50 parliamentarians or the Sejm Presidium, and elected by an absolute majority of votes.

Previous Attempt to Halt Selection

PiS previously attempted to temporarily halt the judge selection process in the Sejm, filing a request for interim relief with the Constitutional Tribunal.

However, this request did not prevent the Sejm from proceeding with the vote.

The dispute over the composition of the Constitutional Tribunal has been ongoing for years, representing a significant institutional conflict within Poland’s judicial system.

Presidential Oath as Key Factor

The President’s decision on whether to administer the oath of office to the newly appointed judges is now central to the dispute.
