Polish Court Extends Deadline for Infrastructure Linkage Fees

Polish property owners now have more time to pay municipal linkage fees after a court ruling.

Understanding Linkage Fees

The linkage fee is regulated under the Act on Real Estate Management (u.g.n.). It is imposed when the value of real estate increases due to construction of technical infrastructure, including roads.

Legal Framework

According to Article 144 of the Act on Real Estate Management, property owners contribute to infrastructure costs through linkage fees paid to the municipality.

Court Ruling

The Voivodeship Administrative Court in Białystok ruled on July 11, 2023 (case no. II SA/Bk 166/23) that such fees can only be imposed when a road is newly constructed or significantly improved.
