Poland’s Ministry of Development and Technology is reversing a proposal to limit development condition decisions (WZ) to only property owners and perpetual usufruct holders.
Ministry Withdraws from Owner-Only WZ Decision Plan
The Ministry of Development and Technology is withdrawing from its previous proposal that would have restricted applications for development condition decisions (WZ) exclusively to property owners, perpetual usufruct holders, and their proxies. Dziennik Gazeta Prawna (DGP) has obtained access to a new version of the amendment bill to Poland’s spatial planning and development law.
New Requirement Aligns with Building Permit Process
The ministry has decided to introduce the same requirement for WZ applications as applies when obtaining a building permit. This involves linking the development condition decision with the right to dispose of property for construction purposes, which will allow other persons besides owners and perpetual usufruct holders to apply for WZ.
Additional Restrictions Expected Despite Expanded Eligibility
While the change opens the door for more individuals to seek development condition decisions, it does not mean there will be no restrictions. The ministry is expected to implement other criteria that applicants must meet to qualify for WZ.
