Polish MOPS to Overhaul Benefit System with Installment Payments

Poland’s Municipal Social Assistance Centers (MOPS) are proposing a shift to installment-based payments for targeted assistance, replacing multiple applications with a single annual plan.

Current System Inefficiencies

Currently, targeted assistance from MOPS is a one-time payment for specific expenses – such as medication, food, clothing, or minor repairs. This necessitates repeated applications, often every few months, for the same need. For example, someone requiring monthly medication costing 200 zł repeatedly applies for assistance, receiving partial funding and then reapplying when the funds are depleted.

This process has been deemed inefficient, prompting the Ministry of Family to propose a change: a single application with benefits paid in installments.

Proposed Changes: Single Application, Annual Payments

Under the proposed changes, cyclical expenses like medication or food would be covered by a benefit paid regularly – for example, 200 zł monthly, totaling 2400 zł annually. However, the targeted assistance remains discretionary, with installment payments limited to a maximum of one year before requiring reassessment.

Illustrative Case: Elderly Man Needing Medication

An elderly, pensionless 68-year-old man requiring ongoing medication for basic needs applies to MOPS for targeted assistance. He receives a one-time payment of 300 zł, covering approximately two months of medication costs.

Once those funds are exhausted, he must reapply, repeating the process multiple times throughout the year, leading to numerous applications and separate decisions for essentially the same need.

Legal Status and Upcoming Legislation

The proposed amendment to the Social Assistance Act will transition targeted assistance from a one-time benefit to a recurring payment structure, similar to the care allowance.

Discretionary Nature Remains

Despite the changes, targeted assistance will remain discretionary. The decision to provide installment payments will be valid for a maximum of one year, after which the case must be reviewed by MOPS.

The proposed changes aim to eliminate the need for multiple applications for ongoing expenses, reduce administrative burdens, and increase the efficiency of social assistance.

Comparison to Care Allowance

Targeted assistance differs from the care allowance, which is a right-based benefit, not discretionary, and lacks the one-year time limit.

Targeted assistance covers basic, urgent needs such as food, medicine, fuel, clothing, household items, minor home repairs, and funeral costs. Eligibility is generally based on income below the statutory threshold (776 zł for a single person) and a difficult life situation.

Judicial Precedent on Discretionary Decisions

Decisions based on administrative discretion are subject to limited judicial review, focusing on whether the decision was legally permissible and based on a comprehensive assessment of all relevant circumstances.
