Polish Ombudsman Intervenes Over Afghan Deportations to Conflict Zone

Poland’s Ombudsman has questioned planned deportations of Afghan citizens to Kabul, scheduled for April 10-12, 2026, citing ongoing instability and conflict.

Ombudsman’s Inquiry to Border Guard

The Polish Ombudsman (RPO) has again addressed the Commander-in-Chief of the Border Guard, Major General Robert Bagan, with questions regarding the planned deportation of Afghan citizens to Kabul, scheduled for April 10–12, 2026. The intervention stems from serious doubts about the safety of these individuals, particularly given the unstable situation in Afghanistan and the ongoing armed conflict with Pakistan.

UNHCR Concerns and Guidelines

According to guidelines published in September 2025 by the UN High Commissioner for Refugees (UNHCR), Afghanistan continues to experience a severe human rights crisis, a deepening humanitarian crisis, and internal instability. This indicates that deported individuals may be at risk of threats to life, liberty, or personal security, as well as the risk of torture or inhuman or degrading treatment or punishment.

The UNHCR appeals to states to allow civilians fleeing Afghanistan to enter their territories, guarantee the right to seek asylum, and respect the principle of non-refoulement.

Escalating Instability and Armed Conflict

The UNHCR states that the situation in Afghanistan remains unstable and may persist in the near future, significantly hindering the safe return of individuals, even those who do not wish or cannot obtain international protection. Furthermore, since the publication of the guidelines, an armed conflict has erupted between Afghanistan and Pakistan, including Pakistani air force attacks on Kabul.

Request for Deportation Review

Deputy Ombudsman Wojciech Brzozowski asked the Commander-in-Chief of the Border Guard whether, in light of these circumstances, a suspension of the deportation of Afghan citizens to their country of origin had been considered. If no such action has been taken, the RPO requests a re-evaluation of this possibility.

Information on Legal Representation and NGOs

The Ombudsman also inquired whether foreign nationals have been informed of the planned deportation, and if so, when and who is affected. Additionally, the RPO requests information on whether non-governmental organizations authorized to monitor return operations have been notified of the planned deportation and whether any of them have expressed a willingness to participate.

Follow-up Request for Information

Due to the lack of response, the Deputy Ombudsman’s Office (ZRPO) again requested the provision of the required information on April 8, 2026.
