Polish President Intervenes in Borowski Defamation Case

Following a court ruling, Polish President Karol Nawrocki has requested the Prosecutor General review the case of Adam Borowski, sentenced for comments about Roman Giertych.

Court Orders Borowski to Serve Prison Sentence

Warsaw’s Regional Court for the Warsaw-Wola district ruled on March 24th that Adam Borowski must serve a six-month prison sentence for statements made regarding Roman Giertych. The court rejected both the prosecutor’s request for a suspension of the sentence and arguments presented by the defense.

President Requests Case Files

Zbigniew Bogucki, Head of the Chancellery of the President, announced that President Nawrocki had taken action in the case of Adam Borowski, issuing a “decision regarding the application of clemency law.”

According to Bogucki, the President, citing Article 139 of the Constitution, has requested the Prosecutor General (Justice Minister Waldemar Żurek) to submit the case files of Adam Borowski without delay, within a maximum of 30 days.

Borowski’s Case History

In November 2023, the court conditionally dismissed proceedings against Borowski, contingent on an apology to Giertych, which he did not provide. In April 2024, Borowski was sentenced to six months imprisonment, suspended. He still refused to apologize.

In January of this year, Borowski was sentenced to a definitive prison term, but the court first determined his ability to serve it, as he had disclosed a cancer diagnosis. The court subsequently ruled he was fit for imprisonment.

President Previously Aware of Case

In January, while appearing on Telewizja Republika, the President stated he was familiar with the case and knew Borowski, describing him as a courageous anti-communist opposition activist. He indicated he had not yet made any decisions regarding a potential pardon, awaiting a full analysis of the case.

Giertych Accuses Borowski of Mockery

Roman Giertych accused Borowski of defamation related to the Polnord affair in 2020, alleging damage to his reputation and professional trust. Giertych commented on the court’s decision on X, stating Borowski had promised an apology but was now “mocking the administration of justice,” and suggesting he believes President Nawrocki will grant him a pardon.
