Poland’s Deputy Head of President’s Chancellery indicates President Karol Nawrocki may sign the Digital Services Act implementation law.
First Attempt at DSA Implementation
The first attempt to implement the Digital Services Act (DSA) into Polish law was unsuccessful, as President Karol Nawrocki vetoed the amendment to the law on providing services by electronic means, which had been prepared by the government and passed by parliament.
President’s Justification
The head of state justified his decision by noting that during the public hearing conducted by the Sejm on November 4, 2025, numerous organizations requested that provisions concerning orders to take action against illegal content, remove restrictions imposed by service providers, and provide information be separated and developed in a separate legislative procedure.
Content Removal Provisions
The contested provision in the DSA implementation law allows the prosecutor, police, National Tax Administration head, copyright or related rights holder, or service user to apply for an order to remove illegal content from intermediary service providers, when such content may constitute an offense.
