Following a controversial oath-taking ceremony in the Sejm, the Polish President will petition the Constitutional Tribunal regarding the legality of the proceedings.
President to File Constitutional Tribunal Complaint
Bogucki announced that the President will submit a request to the Constitutional Tribunal to resolve the dispute between the President and the Sejm, represented by the Speaker of the Sejm, concerning the recent events.
Bogucki stated that the judges could have waited and exercised patience before proceeding with what he described as a “grotesque and deeply unfortunate act.” He questioned whether political emotions, poor advice, or political pressure influenced their decision.
Constitutional Path, Not Lawlessness
Bogucki emphasized that only the Tribunal can ultimately determine the constitutionality of the action. He asserted that the President is following a constitutional path, unlike the current majority.
President Did Not Set a Deadline for Oath-Taking
The head of the KPRP reminded that the oath of office for Constitutional Tribunal judges should be taken before the President, as was the case with two judges on April 1st at the Presidential Palace.
He also noted that the President does not have a fixed deadline to administer the oath, unlike previous legislation which stipulated 30 days.
Kaczyński Announces Criminal Complaint
Earlier, Jarosław Kaczyński, the leader of Law and Justice, announced the filing of a criminal complaint regarding the oath-taking ceremony in the Sejm, alleging a reasonable suspicion of a crime.
Tribunal President Questions Validity of Oath
Following the oath-taking ceremony in the Sejm on Thursday, April 9th, President of the Constitutional Tribunal, Bogdan Święczkowski, stated that he may not recognize the ceremony as a valid oath before the President.
“Worst Possible Decision”
Święczkowski criticized the judges’ decision, calling it the “worst possible” and accusing them of participating in a media spectacle orchestrated by politicians. He stated that the four judges who took the oath did not assume office or establish an employment relationship.
Judges Sworn In at Sejm
On Thursday, two judges – Dariusz Szostek and Magdalena Bentkowska – whose oaths were already taken by Karol Nawrocki, and four newly elected judges – Krystian Markiewicz, Maciej Taborowski, Marcin Dziurda, and Anna Korwin-Piotrowska – took their oaths in the Sejm.
