Polish prosecutors have requested the European Parliament’s assistance in detaining Confederation party leader Grzegorz Braun over alleged obstruction of justice and other charges.
Braun Faces Detention Request Over Doctor’s ‘Citizen’s Arrest’
The request stems from allegations that Braun interfered with the work of gynecologist Gizela Jagielska at a hospital in Oleśnica in 2025, claiming he was making a “citizen’s arrest.” Charges have already been filed against a party activist, Marta C., and four others in connection with the incident.
Braun has been summoned for questioning three times but has failed to appear, citing reasons for absence or requesting the recusal of investigating prosecutors. Investigators turned to the European Parliament due to what they describe as deliberate obstruction of the investigation.
Multiple Charges Filed Against Braun
Braun faces a total of six charges, four related to the Oleśnica hospital incident. The remaining charges concern the destruction of posters in Opole in March 2025 and incitement to commit crimes in an online program published on December 14, 2023.
Parliamentary Immunity Complicates Detention
Despite the European Parliament lifting Braun’s immunity in November 2024 (related to denying the Holocaust and damaging flags), and again in March 2025 (related to denying genocide and damaging flags), he currently benefits from immunity granted to members of the Polish parliament.
Detention requires the consent of the European Parliament unless Braun is caught “in flagrante delicto” or his arrest is essential to ensure the proper conduct of proceedings. Polish authorities would need to formally request intervention from Belgian authorities to allow local police to detain Braun within the European Parliament.
Investigation into Abortion Case Dismissed
In December 2024, the District Prosecutor’s Office in Oleśnica dropped an investigation into whether Jagielska performed an abortion illegally. The investigation was launched in early 2025 following media reports alleging an unlawful termination of pregnancy at the Oleśnica hospital.
Prosecutors determined that the termination of pregnancy on October 29, 2024, and related actions by the doctor did not constitute a criminal offense.
