President has signed legislation clarifying that the Ombudsman for Children’s Rights must submit property declarations to the First President of the Supreme Court.
New Legislation Clarifies Declaration Requirements
President has signed the January 9, 2026 amendment to the law restricting business activities by public officials. The new law specifies which authority the Ombudsman for Children’s Rights (RPD) should submit property declarations and spouse’s business activity statements to.
Previous Legal Gap Addressed
Previous regulations did not specify the proper authority for accepting these declarations. Because the information constitutes legally protected secret information with a “reserved” classification, this gap could not be filled through extended interpretation.
Independence Considerations
According to the law on the Ombudsman for Children’s Rights, RPD is independent from other state bodies and is accountable solely to the Sejm. The legislator therefore determined that declarations should be submitted to the First President of the Supreme Court, similar to the practice for the Ombudsman for Citizen’s Rights and the Insurance Ombudsman.
Implementation Timeline
The transitional provision states that the new regulations will apply to declarations submitted after the law’s entry into force. The law will take effect 14 days after its publication.
