From October 2024, caregivers face denial of benefits despite eligibility under court rulings.
The ‘Active Parent’ Program
From October 2024, people raising small children can use the ‘Active Parent’ program. Under this program, they can choose from three different benefits, one of which is called ‘active parents at work’, also known as ‘grandmother’s benefit’.
Benefit Denial
It turns out, however, that some caregivers are being denied this benefit by ZUS (Social Insurance Institution). It states that they do not meet the basic condition required by the regulations – which is professional activity – because their health insurance contributions are paid directly to the National Health Fund (NFZ).
Court Rulings
However, rulings by regional administrative courts (WSA) indicate that ZUS is wrong in its interpretation.
