Poland’s 2025 Population Protection Law, aimed at ensuring safety during disasters or war, is exempt from RODO regulations according to legal experts.
New Population Protection Law Takes Effect in 2025
From 2025, the Population Protection and Civil Defense Law will be in force (Journal of Laws of 2024, item 1907). Its objective is to ensure the safety of the population and infrastructure, particularly during a state of natural disaster or war. Whether personal data collected in connection with its implementation are adequately protected and secure remains a question.
Legal Expert Explains RODO Exemption
According to legal provisions, the Population Protection and Civil Defense Law does not apply the General Data Protection Regulation (RODO). This conclusion follows directly from the law’s text. RODO does not apply to data processing in areas of activity not covered by EU law and explicitly states in its recitals that such an area is national security.
National Security Justifies Data Processing Exemption
The Population Protection and Civil Defense Law serves to ensure the safety of the population, and consequently the entire country, which clearly falls within the category of national security. Moreover, this is not an area regulated by EU law.
