Poland’s prosecutor in Oleśnica has closed the investigation into the illegal abortion carried out by Dr. Gizela Jagielska, citing legal arguments over fetal rights.

Grzegorz Braun’s Hospital Visit

The parliamentarian Grzegorz Braun, known for his activist stance, reportedly entered the Oleśnica clinic where illegal abortions were allegedly carried out. Politicians and the public viewed his appearance as a symbolic torch‑bearer of the social crisis.

Anita’s Fetal Bone Fragility Diagnosis

Patient Anita, whose pregnancy began in April 2024, underwent genetic testing at the CSK university clinic in Łódź. Results revealed shortened and bent femur bones, irregular shoulder bones, and a pathogenic COL1A1 gene mutation, consistent with type I–IV osteogenesis imperfecta.

Legal Analysis of Fetal Rights

The prosecutor cited Article 38 of the Constitution, asserting that prenatal life is not covered by the constitution’s life‑protection clause and that abortion is allowed only under defined circumstances, not for fetal anomalies alone.

Public Reaction and Potential Appeal

The decision sparked criticism from political figures, including Supreme Court President Małgorzata Manowska, who hinted at an appeal. Supporters of abortion rights cited the case as evidence of governmental overreach.
