Prosecutors have bypassed a criminal indictment, requesting the Warsaw court order Mieszko R.’s indefinite confinement to a psychiatric hospital. This follows a determination of his legal insanity at the time of the crime.

The request comes after Mieszko R. was accused of the brutal axe murder of a University of Warsaw employee and attempted murder of another on campus. Investigators, based on expert opinions, are seeking a preventative measure of placement in a psychiatric facility.

Defendant Found Fully Insane

A multi-week observation in a closed facility revealed Mieszko R. suffers from psychotic mental disorders. Experts determined he was completely insane at the time of the alleged offenses, precluding criminal culpability and traditional sentencing, including life imprisonment.

Life in Isolation, Despite No Criminal Sentence

Even without a prison sentence, the suspect will not be released. If the court approves the prosecution’s request, the length of stay in the psychiatric hospital will be indefinite, potentially lasting his entire life, unless doctors and the court deem the threat to public safety has ceased.

Experts Warn of Potential Manipulation

Experts highlighted a high, multi-faceted risk of the suspect returning to dangerous behavior. They also noted the possibility of Mieszko R. feigning cooperation with therapy to shorten his isolation, requiring a level of supervision comparable to that of the National Center for the Prevention of Antisocial Behaviors, reserved for the most dangerous criminals.

The case has generated significant emotion due to the extreme brutality of the act, including the desecration of the body and attacks on officers. While Mieszko R. will not be formally convicted, the prosecution’s request aims to permanently eliminate the threat he poses through strict medical isolation.

The final decision regarding the fate of the man, who may spend the rest of his life within hospital walls, now rests with the Warsaw District Court.
