Request Filed to Lift Parliamentary Immunity for PIS MP Michał Woś

Polish prosecutors have requested the lifting of parliamentary immunity for PIS MP Michał Woś over alleged misconduct in Prison Service management.

Request for Immunity Removal

According to the prosecutor’s office, the request to lift parliamentary immunity for Michał Woś is based on findings from an investigation conducted by a team established by the Regional Prosecutor’s Office in Poznan. The probe examines the legality, validity, and efficiency of actions taken between November 2015 and December 31, 2023, concerning the management of the Prison Service.

Basis of Investigation

The proceedings were initiated by reports from the director general of the Prison Service regarding irregularities in creating the Internal Inspection, hiring practices, and financial spending. The prosecutor’s office states that the reports suspect exceeding authority and failing to fulfill duties by Prison Service officials and the former Secretary of State in the Ministry of Justice, which supervises the institution.

Alleged Irregularities

The irregularities reportedly include hiring individuals without proper recruitment processes or qualifications, and making decisions about early promotion of officer ranks in violation of the Prison Service Act of April 9, 2010.

Prosecution’s Assessment

The gathered evidence allows prosecutors to suspect that Woś exceeded his authority and failed to fulfill his duties as a public official. According to investigators, the politician acted to the detriment of public interest to achieve personal or financial gain, particularly by granting higher officer ranks, ensuring appointments to specific positions, and obtaining salaries higher than provided by law.

Legal Process

This constitutes an offense under Article 231 § 2 kk in connection with Article 12 § 1 kk. Due to Woś’s parliamentary immunity, the Sejm’s consent to hold him criminally liable is necessary to present charges and conduct other procedural activities with his participation.
