The court case concerning the acquisition of Komenda’s estate is active in the Wrocław District Court – Śródmieście. The first trial occurred on 16 October 2024, followed by hearings on 29 November 2024 and 19 February 2025. No next dates have yet been set; the current trial is postponed to a future session, and the files have been returned from the expert.

According to the court’s press office, once the proceedings conclude, the parties will have the right to appeal to the second instance – the Wrocław Regional Court. Because the case is being conducted behind closed doors, no further details will be disclosed.

Tomek Led a Lavish Life

In February 2021, the Opole Regional Court awarded Komenda 12 million zlotys in damages and 811 533 zlotys in compensation for 18 years of wrongful imprisonment. Earlier reports indicated that Komenda had purchased three apartments before his death and gifted one to a brother. The court will ultimately decide on the fate of Komenda’s assets.

The lawsuit is being brought by Komenda’s partner, who represents their four‑year‑old son, and by Komenda’s eldest brother. The exact amount of remaining funds is unknown, as is the full extent of the wealth Komenda accumulated.

Tomasz Komenda and the Miłoszyce Murder

Komenda was arrested in 2000 and convicted in 2004 of raping and murdering 15‑year‑old Małgorzata in Miłoszyce. The crime occurred overnight between 31 December 1996 and 1 January 1997. In May 2018, the Supreme Court acquitted Komenda after prosecutors re‑examined evidence years later.

Further investigations into Małgorzata’s murder led to wrongful convictions of two men in September 2020; their sentences were later reduced or overturned in subsequent proceedings.

Recent Verdicts and Komenda’s Death

In December 2021, the Wrocław Court of Appeal reduced one convict’s sentence to 15 years. The Supreme Court rejected a subsequent appeal in 2023. Komenda died on 21 February 2024 at age 46, reportedly battling cancer.
