WIBOR Before EU Court. Wave of Lawsuits Ahead?

Polish Supreme Court refers WIBOR cases to EU Court; lawyers anticipate ruling could trigger flood of lawsuits against banks.

TSUE to Rule on Złotówkie Loans

On 12 February, the Court of Justice of the European Union (TSUE) will answer four questions referred by the District Court in Częstochowa regarding złot-denominated loans (case C-471/24).

Several other cases concerning WIBOR are already pending before the TSUE awaiting judgment.

Lawyers Anticipate Legal Tsunami

Lawyers specializing in foreign currency loans expect the TSUE’s Thursday ruling to favor złotkie borrowers. Similar to the Dziubak case (C-260/18), they predict it could spark a wave of lawsuits against banks that used WIBOR.
