Will Employers Recover Money from Workplace Bullies? RCL Expresses Doubts

Government Center for Legislation questions whether employers can successfully reclaim funds from workplace bullies under new Labor Code amendments.

Employee Liability for Mobbing

The issue concerns the material responsibility of employees for workplace mobbing behavior.

New Compensation Requirements

A draft amendment to the Labor Code introduces a minimum compensation for mobbing, set at at least six times the minimum wage.

Potential Legal Limitations

Although the bill explicitly provides for the right of recourse against the mobbing perpetrator, the Government Center for Legislation (RCL) suggests this may be limited by general provisions of the Labor Code on employee material liability.

These provisions typically cap an employee’s financial liability at three months’ wages.
