Former Deputy CBA Prosecutor Accused of Delivering 15‑DVD Bundle of Confidential Recordings

Charges Against Former Deputy CBA

The prosecutor from Investigation Team No. 3 of the National Prosecutor’s Office formally charged Daniel K., former deputy chief of the Central Anti‑Corruption Bureau (CBA), with exceeding authority and revealing privileged information obtained during official duties. This announcement was made on Wednesday, 22 October.

Alleged Transfer of Confidential Recordings

Investigators allege that on 8 July 2020, Daniel K. delivered to then‑national prosecutor Bogdan Święczkowski a 15‑DVD set containing eavesdropped conversations of Roman Giertych and other data extracted from his phone by the Pegasus system. Part of this material was protected by defense secrecy and attorney‑client privilege. The prosecutor explained that defense secrecy is absolutely inadmissible as evidence and must be destroyed immediately, whereas attorney‑client privilege is relatively protected and may only be used after court assessment.

Daniel K. is alleged to have no authority to provide such privileged material, constituting a breach of public interest and the rights protected between client and lawyer. He was questioned as a suspect but denied wrongdoing and provided explanations. Investigators judged that no preventive measures were necessary against him, yet he faces up to three years’ imprisonment if found guilty.

Context: 2020 Investigation into Polnord and Giertych

The case dates back to 2020 when Roman Giertych, acting as lawyer, represented about 30 clients, including Leszek Czarnecki, one of Poland’s richest, and politician Stanisław Gawłowski. The CBA was probing money‑laundering allegations involving the developer company Polnord founded by Ryszard Krauze. Giertych was considered a key figure in the alleged scheme, prompting surveillance that yielded the phone data now central to the charges against Daniel K.
