Can Grzegorz Braun’s Party Be Delegalised? A Big Dilemma

Polish authorities are debating whether to delegalise Grzegorz Braun’s Confederation of the Polish Crown party amid allegations of hate speech and violent attacks.

Aims to Delegalise the Party

The civil‑society group Action Democracy has filed a motion to delegalise the Confederation of the Polish Crown, the party led by Grzegorz Braun.

They cite repeated verbal and physical attacks and argue that Braun’s organisation encourages nationalist hatred and violence, which, according to them, meets the constitutional criteria for delegalisation.

Government Comments

Polish Minister of Interior and Administration Marcin Kierwiński stated that the party is “at the border of delegalisation” and would cross if further incidents occur.

Foreign Minister Radosław Sikorski echoed that propagating Nazi ideology is prohibited and warned of constitutional obligations.

Other Parties on the Menu

The Confederation is not the only party facing scrutiny; the former president’s office sent the Communist Party of Poland to the Constitutional Tribunal on 12 November.

The Tribunal ruled on December 3 that the KPP’s aims violate the Constitution, but a 2020 attempt to delegalise it was postponed due to a lack of a new prosecutor.

Constitutional Grounds

Article 13 of the Constitution forbids parties that endorse totalitarian methods or hate, violence, or conceal membership.

Action Democracy cites this article in its appeal, claiming Braun’s party exceeds these limits.

After Delegalisation

Experts note that delegalising the party could leave Braun free to form or join another group, raising questions about individual versus party accountability.

Krzysztof Izdebski argues enforcement should focus on Braun’s actions rather than the party itself.
