Who Has Legal Priority for Rehabilitation?
According to Article 47c of the Act of August 27, 2004, on health care services financed from public funds, certain groups of beneficiaries have the right to use health care services out of turn. This includes persons with significant disabilities, war veterans, individuals with certificates of disability, persons under state care, and those whose condition results from a crime or occupational disease.
What Does “Out of Turn” Actually Mean?
The regulation does not automatically provide the right to immediate service in every situation. The law states that the service should be provided on the day of application, or if that’s not possible, at another date outside the normal waiting list queue. For rehabilitation, this means prioritized placement on the list, but not necessarily immediate treatment.
Priority vs. Emergency Cases
Legal priority does not replace medical qualification. Regardless of special rights, healthcare providers must consider the patient’s health condition and other priority bases under the regulations. In practice, this means balancing various categories – such as health emergencies and statutory entitlements – according to legal and medical standards.

To avoid misunderstandings, it’s important to clarify the boundaries of this right. Statutory priority means changing the order of implementation of publicly funded services, not guaranteeing immediate performance of procedures. It does not exempt patients from medical qualification or create an accelerated treatment system.
How to Access Rehabilitation Without Waiting
To benefit from the right to services out of turn, patients should present appropriate documentation confirming their right to priority during registration. If conditions are met but the time doesn’t differ from the standard queue, patients can seek clarification from the head of the institution, and if necessary, from the relevant NFZ regional branch or the Patient Rights Ombudsman.
Why This Matters: The Importance of Timely Rehabilitation
Persons with significant disabilities often require regular, long-term rehabilitation. Long waiting times can lead to decreased physical ability and limited independence. Statutory priority aims to reduce this risk by accelerating access to services within the public system. It does not, however, eliminate contractual or organizational limits.
Home Rehabilitation on NFZ
For patients whose health condition prevents independent travel to a facility, home rehabilitation financed by NFZ may be available. This guaranteed service is provided based on a referral and upon meeting specific medical criteria. It is not a service “on request” – the medical necessity is determined by the referring physician and medical qualification.
