Indictment Filed After Father and Son Killed in Head-On Collision on Wisłostrada

Prosecutors have filed charges against a driver who killed a father and son in a head-on collision on Warsaw’s Wisłostrada while exceeding 100 km/h.

The Accident

On July 10, 2025, a fatal accident occurred on Wybrzeże Gdyńskie street in Warsaw. According to prosecutors, Dawid F., driving an Opel Vectra at 108 km/h, crossed into oncoming traffic and collided head-on with a properly moving Yamaha motorcycle.

The collision ejected both the motorcycle’s driver and his underage passenger from the vehicle, causing multiple organ injuries. Both victims died on July 11, 2025.

The Charges

Dawid F. has been charged with causing a fatal accident, leaving the scene, and then consuming alcohol before examination by authorized authorities. He was also charged with driving despite a three-year driving prohibition issued by the District Court in Radom on September 3, 2024.

Mariusz P., who was a passenger in the vehicle, has been charged with failing to provide assistance to the victims, despite being able to do so without endangering himself or others.

Background and Legal Context

Dawid F. admitted to the charges and provided explanations consistent with the evidence. He claimed he fled because he feared consequences and was aware of his driving ban. After leaving the scene, he took a taxi to a hostel, bought alcohol at a gas station, and drank it in the taxi and his room.

Mariusz P. did not admit to the charges and provided his own explanations. Dawid F. had previously been convicted for drunk driving, while Mariusz P. had prior convictions for family-related offenses and was wanted under an arrest warrant at the time of his apprehension.

The prosecutor’s office noted that the charge of causing a fatal accident (Article 177 § 2 of the Penal Code) may be enhanced under Article 178 § 1a, especially when the perpetrator flees the scene or consumes alcohol before examination. This offense carries a prison sentence of 5 to 20 years.
