Presidential Spokesman Announces Constitutional Tribunal Judge Swearing-In

Presidential spokesman Rafał Leśkiewicz announced Wednesday that the President intends to resolve the situation at the Constitutional Tribunal.

Constitutional Tribunal Judge Swearing-In Announced

Presidential spokesman Rafał Leśkiewicz stated Wednesday that the President “decided to regularize the situation at the Constitutional Tribunal as the highest representative of the Polish state and guardian of the constitution.” He noted that the ruling government had not selected judges for vacancies at the Constitutional Tribunal.

Leśkiewicz also pointed out that the government of Donald Tusk had not paid the salaries of Constitutional Tribunal judges.

Upcoming Press Conference

Leśkiewicz announced that a press conference will be held at noon by Zbigniew Bogucki, who will provide details regarding the President’s actions concerning the Constitutional Tribunal.

When asked if the swearing-in would be accepted from the two Constitutional Tribunal judges invited to the Presidential Palace, he replied, “Let’s wait until noon.”

Newly Elected Judges

On March 13th, the Sejm elected Krystian Markiewicz, chairman of the commission for the codification of judicial and prosecutorial structure; Maciej Taborowski, PhD, professor at the Institute of Legal Sciences of the Polish Academy of Sciences; Marcin Dziurda, PhD, professor at the Department of Civil Procedure at the Faculty of Law and Administration of the University of Warsaw; Anna Korwin-Piotrowska, judge and former President of the Regional Court in Opole; Dariusz Szostek, PhD, professor at the University of Silesia; and attorney Magdalena Bentkowska.

Oath Requirement

According to the Act on the Status of Constitutional Tribunal Judges, a person elected to the position of judge must take an oath before the President of the Republic of Poland.

Invitations to Presidential Palace

Dariusz Szostek confirmed Tuesday that he received an invitation to the Presidential Palace for Wednesday. He added that, to his knowledge, another elected Constitutional Tribunal judge, attorney Magdalena Bentkowska, also received an invitation. Szostek’s invitation is for 11:30 AM, while Bentkowska’s is for 11:00 AM.
